Manitoba will join nine US states that are suing the US EPA over administrative rulings that may hurt fishing and contaminate drinking water. The main reason for Manitoba to join into the lawsuit is the ongoing and unresolved issue concerning the North Dakota Devils Lake outlet.

The main issue is that the suing states maintain that Washington has created a loophole which may allow the transfer of polluted or contaminated water by ship from one water body to another where it would do harm. So the issue is state control over water that will effect them.

Manitoba contends that North Dakota is violating the provisions of its permit to operate the Devils Lake outlet.

Apart from Manitoba and New York, the Bush administration is being sued over this issue by Connecticut, Delaware, Illinois, Maine, Michigan, Minnesota, Missouri and Washington.
